UNITY COSMETICS B.V.

1. Relevance
Unity Cosmetics B.V. provides cosmetic products to consumers within the European Union. These terms and conditions apply to all items offered by Unity Cosmetics B.V. and by an order, purchase or acceptance of an offer, the customer indicates that he/she agrees to these terms and conditions.

2. Prices
All prices are in Euro's, including VAT and excluding shipping and handling charges (which are listed separately). All prices are subject to change. Unity Cosmetics B.V. reserves the right to change prices at any cost by changing (legal) requirements, production costs, product changes, or market developments. In case of any price increases the customer will be notified and will have the right to cancel a pending order.
If a product is ordered and paid for but unfortunately not available, we will contact the customer to refund the money already paid, or to deliver the product at a later time, depending on customer's preference.
Unity Cosmetics B.V. pays the utmost attention to the proper indication of prices and colors. In the unlikely event that it appears that errors occur in our information, Unity Cosmetics B.V.has the right not to supply the articles. The customer will receive a notification about this as soon as possible.

3. Payment
a. Webshop
The webshop of Unity Cosmetics B.V. accepts iDEAL payments, PayPal payments and prepayment by bank transfer. On the customer's invoice an account number of Unity Cosmetics B.V. is present, where the customer can transfer the money to, by quoting the order number.
To be able to make orders over the internet, Unity Cosmetics B.V. uses hosting through a third party specialized in secure online payments and orders. Errors that result from this third party are not to charge to Unity Cosmetics B.V.
b. Home-party
At a Home-party Unity Cosmetics BV accepts ATM or cash payments. After payment the customer will receive a receipt. To be able to receive payment via ATM, Unity Cosmetics B.V. uses hosting through a third party specialized in secure debit card payment. Errors that result from this third party are not to charge to Unity Cosmetics B.V..
c. Shop/promotional events
A purchase in the shop or during promotional events can be paid cash or by ATM. After payment you'll receive a receipt. Unity Cosmetics B.V. uses hosting services by third parties specialized in safe and secure payment. Unity Cosmetics B.V. is not responsible for any mistakes resulting from this.
d. Gift vouchers
If you chose to pay with a gift voucher, and the voucher exceeds the amount of the order, you will not get a refund for the exceeding part in the web shop. If you pay with a voucher during home-parties, events or in the shop, you’ll get a refund cash or with a new voucher, depending on your choice.

4. Shipping
a. Webshop
Products purchased through the webshop Unity Cosmetics B.V. will be sent via TNT Post - packed in protective bubble envelope or carton - to the address provided by the customer within the European Union. Depending on the weight and dimensions of the product, packet delivery could be applicable. Shipping the products to the address provided by the customer is for the risk of the customer. If the customer purchases products through the webshop, the shipping costs will be visible immediately. In case the customer wants to pick up the items at the shop, the shipping costs will be removed from the shopping cart, shipping costs will not apply.
Upon receipt of customer's payment Unity Cosmetics B.V. strives to ship your purchase within one business day. However, there is always the chance of a delay caused by e.g. a delay at the bank. In such a case, Unity Cosmetics B.V. can not be held responsible for that, and it's no reason to cancel the pending order.
During the order and payment process the customer will receive several emails with information on the status of the payment and the shipping of the purchase.
In case the customer prefers to pick up the items at the shop, the customer will be asked to contact Unity Cosmetics B.V. to make a pick up appointment. The purchase will be handed over after having received the payment.
b. Home-party
Products bought at a Home-party, are immediately available from stock. If a product is not currently available, the order against the then current product price will be transferred to a delivery on a later moment, and the goods will be paid for by the customer cash or ATM or, at a later time, via the webshop using advance payment by bank transfer or iDEAL. After receiving the payment the products will be shipped within one business day, without shipping costs.
c. Shop/promotional events
In case you make a purchase in the shop or during promotional events, the purchase will be handed over immediately after having received the payment.

5. Shipping costs
The cost of packaging and shipping of products within the European Union are published on the webshop of Unity Cosmetics B.V. and may be adjusted annually.

6. Returns
Within 10 days after receipt of the products, a customer is entitled to return a purchase without any reason. The product should be intact and unused, and the invoice should be returned as well. If a customer wishes to return, the customer should contact info@unitycosmetics.com for further instructions. Shipping of the returned goods is at cost and at risk of the customer.

Once Unity Cosmetics B.V. has received the product (s) in undamaged and original condition, the customer will receive a refund of the purchase price as stated on the enclosed invoice minus shipping costs to a bank account determined by the customer, within 14 days.
If it is suspected that the product has been used, or damaged by the customer on purpose, Unity Cosmetics B.V. reserves the right to refuse the returned product.

7. Resellers
If you’re interested in reselling products of Unity Cosmetics B.V., Unity Cosmetics will draw up a Contract Reselling. In addition to that contract, the Terms and Conditions Unity Cosmetics B.V. will remain applicable as well.

8. Guarantee
Unity Cosmetics B.V. guarantees that its products meet the usual requirements and standards that can be set for the specified product. Should you have a complaint, please contact Unity Cosmetics B.V. within 14 days of receipt of the products through info@unitycosmetics.com. You'll receive a reply to your complaint within 14 days ultimately.

9. Colors
Unity Cosmetics B.V. seeks the colors of the make-up products as accurately as possible to approach on its website. Please mind that all monitors and printers use different color settings and might cause slight color variations.

10. Data Protection Act (WBP)
The Dutch Data Protection Act requires that personal information may only be used if it's approved by the owner, and that no more data is collected than is strictly necessary. When ordering products various personal information is requested to be able to ship the product to the customer. Unity Cosmetics B.V. requires this information for the specific purpose of shipping. Customer's personal information will not be provided to third parties.
Only if a customer explicitly consents to Unity Cosmetics B.V. that (part of) this information can be used for newsletters and promotions, or if a customer creates an account, customer's personal data are stored in a database for such purposes. Of course a customer can unsubscribe at any time for a newsletter or a customer account.

11. Property
No brochures or materials from the websites owned by Unity Cosmetics B.V. may be copied, reproduced, republished, uploaded, posted, transmitted or distributed without explicit permission of Unity Cosmetics B.V.. Any unauthorized use of any material on this website or leaflets of Unity Cosmetics B.V. may violate the copyright, trademark laws or other laws and may result in legal action.

12. Location of the terms and conditions
These terms and conditions have been filed and are available at www.voorwaarden.net. These terms and conditions are also published on the webshop of Unity Cosmetics B.V.. The last registered version or the version applicable on purchase of items applies.

13. Applicable law
All rights, obligations, offers, and orders to which these terms and conditions apply, including these terms and conditions, apply only under Dutch law. By placing an order the customer declares himself known with and agree to these terms and conditions.
